1) Acceptance of Terms

3) Eligibility
You must (a) be at least 18 years old (or the age of majority in your jurisdiction), and (b) have the legal capacity to enter a contract. Some courses require professional qualifications (e.g., Audiologist, PT); eligibility criteria will be listed on the course page.
4) Accounts & Security

You are responsible for the accuracy of your registration information and for safeguarding your login credentials.

You must promptly notify us of any unauthorized use of your account.

We may suspend or terminate accounts that violate this Agreement.
5) Course Access & Learning Content

License: When you enroll, MedExcel grants you a limited, non-exclusive, non-transferable license to access the purchased course content for personal, educational use, subject to any stated access window (e.g., time-limited access).

No Resale/Sharing: You may not share, sublicense, resell, or publicly display course materials without written permission.

Assessments/Certificates: Some programs include assessments, required attendance, identity checks, or proctoring. Meeting listed requirements is necessary to receive a certificate of completion or co-branded certificate (where applicable).

Program Changes: We may update modules, schedules, faculty, or delivery format to maintain academic quality or compliance.
6) Academic & Accreditation Partners

Certain courses may be co-developed or certified with partners (e.g., KMC Manipal or others). Partner involvement and certification details will be specified in each course description and may change.

Unless explicitly stated, MedExcel is not a university and does not award academic degrees or government licensure. Certificates indicate completion of the specified program, not clinical privileges or legal qualification.
7) Professional & Medical Disclaimers

No Medical Advice: Course content and resources are for educational purposes only and are not a substitute for clinical judgment, diagnosis, or treatment. Always follow local regulations, institutional protocols, and current evidence when treating patients.

Patient Data: Do not upload protected health information (PHI) unless a secure, designated workflow explicitly supports it and you have obtained all required permissions/consents. You are solely responsible for de-identifying data you share during coursework or case discussions.
8) Pricing, Payments & Refunds

Prices, taxes, and payment terms are displayed at checkout and may vary by location and currency.

Refunds: Course pages will specify each program’s refund/deferral policy (e.g., cooling-off period, deadlines before cohort start, non-refundable administrative fees). Unless a course page states otherwise, fees are non-refundable once content access is granted or the cohort begins.

If a program is canceled by MedExcel, you will receive a full refund or a free transfer to a future cohort.
9) User Conduct & Academic Integrity
You agree not to:

Cheat on assessments, share answer keys, or misrepresent your identity.

Copy, record, scrape, or redistribute course content without permission.

Upload malware, spam, infringing, or unlawful content.

Harass learners or faculty, or disrupt learning experiences.
Violation may lead to suspension, certificate revocation, or legal action.
10) User Content & Feedback

If you submit posts, assignments, questions, reviews, or feedback (“User Content”), you grant MedExcel a worldwide, royalty-free, sublicensable license to use, reproduce, adapt, and display such content for operating and improving the Services (including marketing testimonials with your consent).

You represent that you have the rights to the User Content you submit and that it does not violate any third-party rights.
11) Intellectual Property

All MedExcel content (videos, slides, text, graphics, logos, trademarks, and software) is the property of MedExcel or its licensors and protected by IP laws.

You receive no rights other than the limited license described in Section 5.
12) AI & Automated Tools (If Provided)
Some features (e.g., automated report templates, AI-assisted feedback) may be available in certain courses. You acknowledge that:

Outputs may be incomplete or require expert review.

You remain responsible for clinical interpretation and patient safety.

Do not input PHI unless the feature explicitly supports it and appropriate consents are in place.
13) Third-Party Services & Links
Our Services may link to third-party websites, tools, or platforms (e.g., video hosts, payment gateways). We are not responsible for their content, policies, or availability. Your use of third-party services is governed by their terms.
14) Communications & Notifications
By creating an account, you consent to receive transactional and service-related emails/SMS (e.g., enrollment, schedules, policy updates). You may opt out of non-essential marketing communications at any time.
15) Accessibility & Accommodations

16) Privacy
Our Privacy Policy explains how we collect, use, and protect personal data. By using the Services, you consent to those practices. Where required, we process data under appropriate legal bases and implement reasonable security measures.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted access, error-free content, or that completion of a course will result in employment, credentialing, or specific outcomes.
18) Limitation of Liability
To the maximum extent permitted by law:

MedExcel and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits/revenue/data.

Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to MedExcel for the course giving rise to the claim (or USD/EUR/INR $100 if no fees were paid).
19) Indemnification
You agree to defend, indemnify, and hold harmless MedExcel, its affiliates, and personnel from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your: (a) use of the Services; (b) violation of this Agreement; or (c) infringement of any third-party rights.
20) Suspension & Termination
We may suspend or terminate your access if you violate these Terms or create risk for others. You may stop using the Services at any time. Certain provisions (e.g., IP, disclaimers, limitation of liability) survive termination.
21) Changes to Services or Terms
We may update the Services and these Terms from time to time. Material changes will be notified via the site or email. Continued use after changes become effective constitutes acceptance of the revised Terms.
22) Governing Law & Dispute Resolution
